Terms and Conditions - LetJoKnow

These Conditions shall apply and be deemed accepted by any Candidate who uses the Services provided by LetJoKnow after the date on which these Conditions were posted on the Site.

1. Definitions

In these Conditions, the following words and phrases shall have the following meanings unless the context requires otherwise:

Candidate: a person who registers with LetJoKnow for the purpose of finding employment;

Candidate Information: any information the Candidate is required to disclose to LetJoKnow and/or a Client, including without limitation, education, employment, training history and contact details (as applicable);

Client: a business client of LetJoKnow searching for a Candidate to fill a Vacancy;

Conditions: these Candidate Terms and Conditions;

Candidate Support Telephone Line: the Candidate support telephone line operated by LetJoKnow;

LetJoKnow: LetJoKnow Limited, a company incorporated in England and Wales (company number 06034533) with business address at Langstone Technology Park, Langstone Road, Havant PO9 1SA, and registered address at Northcliffe House, 2 Derry Street, Kensington, London W8 5TT;

Site: the Site at www.letjoknow.com;

Services: any services provided by LetJoKnow to Candidates from time to time, including without limitation, assisting Candidates to find employment with LetJoKnow's Clients by use of text message, this Site or the Candidate Support Telephone Line;

Vacancy: a position advertised by a Client where details are sent by text to selected Candidates.

2. Services

2.1. LetJoKnow does not make any representation whatsoever about any Client or any Vacancy. LetJoKnow relies on information provided to it by its Clients. Accordingly it is a matter for the Candidate to satisfy itself as to the suitability of any Client or Vacancy.

2.2. LetJoKnow shall be entitled to make changes to the Services or withdraw the services at any time./p>

2.3. LetJoKnow shall not be responsible for any failure to provide the Services.

2.4. LetJoKnow cannot guarantee that the Candidate will be contacted by Clients when the Candidate is available for employment.

2.5. LetJoKnow reserves the right to cease providing the Services to any Candidate at its absolute discretion and without notice.

2.6. LetJoKnow shall only collect and process Candidate's personal data for the purpose of providing the Services (or as may otherwise be expressly agreed by the Candidate) and always in accordance with any applicable data protection legislation in the United Kingdom.

3. Candidate Information

3.1. The Candidate confirms and warrants that the Candidate Information is factually correct and that the Candidate shall update the Candidate Information as necessary to ensure that it remains accurate.

3.2. The Candidate agrees that the Candidate shall not accept any Vacancy unless the Candidate has the necessary qualifications required by law and the appropriate skills required by the Client.

3.3. LetJoKnow shall not make Candidate Information available to Clients if the Candidate has notified LetJoKnow not to do so.

3.4. If any of the Candidate Information is found to be false or inaccurate in any way, LetJoKnow reserves the right to cease providing the Services to the Candidate.

3.5. The Candidate agrees to provide Candidate Information to LetJoKnow in such format as LetJoKnow may request.

4. Candidate Availability

The Candidate shall notify LetJoKnow when the Candidate is or is not available for employment.

5. Liability

5.1. To the extent permitted by law, LetJoKnow excludes any and all liability whatsoever under the Conditions, including without limitation, for:

5.1.1. any loss of physical materials that the Candidate supplies to LetJoKnow. The Candidate is advised to retain in its possession sufficient quantity of such materials for its purposes;

5.1.2. any mistakes or errors made by LetJoKnow in the course of providing the Services;

5.1.3. any failure of the Candidate to secure employment; and

5.1.4. any loss or damage to the Candidate arising out of any Client's negligence, dishonesty, misconduct, incompetence, or any Client's misuse of the Candidate Information.

5.2 Nothing in these Conditions restricts or excludes LetJoKnow's liability for death or personal injury caused by its own negligence.

5.3 The Candidate acknowledges that no condition, warranty or representation of any kind is, has been, or will be, given by or on behalf of LetJoKnow in respect of or in connection with the Services and accordingly the Candidate confirms that it has not, in accepting these Conditions, relied on any condition, warranty or representation by LetJoKnow or any person on its behalf, express or implied, whether arising by law or otherwise in relation to or in connection with the Services.

5.4 The Candidate hereby indemnifies LetJoKnow against all costs, claims, damages, losses, expenses and liabilities suffered or incurred by LetJoKnow as a result of any breach of the Candidate's warranty at Clause 3.1 and its obligations at Clause 3.2.

6. Cancellation

The Candidate shall be entitled to cancel LetJoKnow's provision of the Services at any time by sending an email to cancel@letjoknow.com or calling the Candidate Support Telephone Line.

7. General

7.1. No communication by the Candidate to any Client shall be offensive, obscene, indecent, defamatory, or designed or likely to cause annoyance or anxiety.

7.2. If any provision of these Conditions shall be invalid or unenforceable, it shall not affect any other provision, which shall remain in full force and effect.

7.3. These Conditions shall be governed by and construed in accordance with English law and LetJoKnow and the Candidate submit to the exclusive jurisdiction of the English courts in respect of any dispute or matter arising out of or in connection with these Conditions.
